Please read these Terms of Service ("Terms") carefully before using the CreatorPost service ("Service") operated by CreatorPost ("we," "us," or "our") at creatorpost.app.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, do not use the Service.

1. Use of the Service

CreatorPost provides tooling for content creators to schedule and automatically publish video content to TikTok using TikTok's official Content Posting API. The Service is intended for personal or business use by content creators who own or have authorization to publish the content they submit.

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Upload or publish content that you do not own or have the rights to publish.
• Publish content that is defamatory, obscene, harassing, hateful, or otherwise objectionable.
• Circumvent or interfere with TikTok's terms of service or content policies.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Use automated scripts or bots to interact with the Service beyond its intended functionality.

2. TikTok Platform Terms

Your use of CreatorPost in connection with TikTok is also subject to TikTok's Terms of Service and Community Guidelines. We are not responsible for TikTok's actions, including the rejection, removal, or restriction of content you attempt to publish.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage resulting from unauthorized access due to your failure to safeguard your credentials.

4. Content Ownership

You retain full ownership of all video content and related material you submit through the Service. By using CreatorPost to publish content, you grant us a limited, non-exclusive, royalty-free license to process and transmit your content solely for the purpose of delivering it to TikTok on your behalf.

We do not claim any ownership over your content and will not use it for any purpose other than providing the Service.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that posts will be published at the exact scheduled time.

6. Limitation of Liability

To the fullest extent permitted by law, CreatorPost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of revenue, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount paid by you (if any) to use the Service in the twelve months preceding the claim.

7. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
